ANNEX-2 BAYTII Services
BAYTII Services BAYTII may make price and/or rule and/or content changes or terminate any of its services at any time without any notice or notification to the Visitor or the Member in relation to the services mentioned below and other services to be implemented over time. Changes made by BAYTII regarding its services shall be valid as of the date of their publication on the Portal. Any natural or legal person accessing the Portal shall be deemed to have accepted all changes made by BAYTII.
BAYTII Services
The Member shall create his/her advertisements through his/her BAYTII Account in accordance with the rules set by BAYTII and upload them to the BAYTII Database. BAYTII can evaluate the advertisement(s) created by the Member, but this is not a legal obligation. BAYTII shall freely determine and determine the criteria, conditions, and periods for the evaluation of the advertisements. The Member agrees and undertakes to act in accordance with these conditions and the provisions of the legislation. BAYTII can temporarily or permanently suspend the publication of the relevant advertisement without any notice to the Member for reasons such as the advertisements published on the Portal being against the law and morality, infringing the personal and commercial rights of others or being the addressee of notices made in this direction or directly or indirectly violating the terms and conditions contained in this annex and the Portal. BAYTII accepts, declares, and undertakes that it will not make any reimbursement to the Member regarding the aforementioned situation, and likewise, the Member accepts, declares, and undertakes that he/she will not demand and sue BAYTII for the return of the price he/she has paid. BAYTII may make an agreement with third parties in order to display the Member's advertisements and the texts, images, and contents within the advertisement on other sites, search engines, and BAYTII advertisements, and advertisements. The Member expressly declares and accepts that he/she authorizes BAYTII in this respect. The Member accepts, declares, and undertakes that he/she shall be responsible for all kinds of business and transactions carried out through his/her BAYTII Account and that he/she shall not assert any defense and/or objection that he/she did not carry out the business and transactions carried out herein and/or shall not refrain from fulfilling his/her obligations based on such defense and/or objection. The Member accepts, declares, and undertakes that he/she will not take any unlawful action or transaction such as defamation, commercial slander, threat or harassment in the advertisements to be published on the Portal, will not take initiatives and actions that will bring unjustified or excessive burden to the infrastructure of the Portal, and will not allow texts and images with disgraceful, pornographic or immoral content to be included in the advertisements to be published on the Portal. The Member shall advertise and promote its goods and services with real, accurate and lawful information in the advertisements published on the Portal. It is forbidden for the Member to advertise goods and services over which he/she is not legally authorized to dispose as stated in his/her advertisement. In this context, BAYTII may temporarily suspend the Member's Account, close the Member's Account, and unilaterally terminate the Individual or Commercial Membership Agreement without any payment obligation without any notice to the Member. The member accepts, declares and undertakes that he/she will not make any advertisements contrary to any legislation, including but not limited to those regulating consumer protection, intellectual rights, unfair competition, advertising issues, and that his/her advertisements will not contain statements contrary to these legislations and visuals such as pictures, videos. BAYTII reserves the right to temporarily suspend or close the account of the relevant Member in case of detection of any contrary situation and may immediately terminate the Individual or Commercial Membership Agreement unilaterally and without compensation without any notice. The Member accepts, declares, and undertakes to pay the fee announced by BAYTII for the category he/she has selected. The Member may publish his/her advertisements on the Portal in a section of his/her own, with the content and information determined by him/her, as explained in detail and with the limits specified in the Profile Page section of the Portal. The Member must accept, declare and undertake to comply with the rules and conditions specified in all annexes and agreements, except for this annex, in order to publish the advertisements as specified in this article. Natural or legal persons using the Portal can open only one account on the Portal. For this purpose, Visitors accept, declare, and undertake not to open more than one BAYTII Account by using different usernames, e-mail addresses, and telephone numbers. If BAYTII determines that this rule has been violated, BAYTII may temporarily suspend all BAYTII Accounts of the Member or close the account of such Member. If a user whose account has been closed or suspended for any reason opens a new account to access the Portal and this new account is detected by BAYTII, BAYTII reserves the right to cancel all BAYTII Accounts of this user without any notice and to unilaterally terminate this Agreement without any obligation to refund any fee, compensation or penal clause.
BAYTII Secure Electronic Commerce Service
Secure Electronic Commerce Service; Providing the infrastructure that will enable the Members who have the title of Host or Guest to agree on Short Term Rental Service in an online environment by using the infrastructure of the Portal, in accordance with the terms of the agreement reached through this infrastructure, in the event that the obligations assumed by the parties are fulfilled in full and this situation is duly notified to BAYTII by the parties within the conditions specified in this Membership Agreement, the product price transferred by the Guest Member to BAYTII's Secure Account will be transferred to the Host Member's account, if the Host Member does not fulfill its debt properly and this situation is notified to BAYTII by the Guest Member within the framework of the conditions specified in the Short Term Rental Agreement; The system, the details of which are described in this Agreement and its annexes, which are an integral part of this Agreement, and in the Portal, which ensures that the product price transferred by the Guest Member to BAYTII's Secure Account is returned to the Guest Member within the framework of the conditions specified in this Agreement. The following provisions regulate the rights and obligations of the Member, who has the title of Host or Guest, using BAYTII Secure Electronic Commerce Service, and BAYTII's situation against these rights and obligations.
Rights and Obligations of Members
In the Secure Electronic Commerce Service, if the Member wants to buy or rent the Real Estate advertised on the Portal, he/she can contact the Member who published the advertisement for this purpose via WhatsApp via the button on the BAYTII internet portal. BAYTII shall have no responsibility for the subsequent communications of the parties and the agreements to be concluded because of these communications, etc. BAYTII shall have no responsibility. Members accept and declare that BAYTII does not have and does not need to have information about any issues related to the product and service, including whether the products and services offered for sale/rental by other members are defective, whether they are listed, whether they are among the products prohibited for sale, their quality, originality, accuracy, and completeness of the written and/or visual descriptions used in the promotion of the product, and that BAYTII has no obligation to undertake and guarantee them. The Member accepts and undertakes that he/she has the absolute right and authority to dispose of the real estate offered for sale or lease in an uncontested manner; that there is no legal or actual obstacle to the sale or lease of the said real estate by him/her. Members accept and undertake that the advertisements to be placed by them are not contrary to the rules regarding the use of the Portal and the services offered on the Portal and the account and the conditions regarding the account, determined by the provisions of all contracts and annexes or specified in the relevant parts of the Portal and that they comply with all applicable legislation. The Member accepts that he/she bears all legal responsibility for the advertisement(s) he/she publishes and that BAYTII is not a party in any capacity to the sales/lease agreements concluded as a result of these advertisements and that these agreements are not in a direct or indirect relationship with him/her in any capacity. The Member accepts, declares and undertakes that he/she is liable for any legal, commercial, and administrative claims that may arise due to the existence of obstacles to the transfer or lease of the real estate offered for sale and lease and specified in his/her advertisement and that he/she is responsible for any legal, commercial and administrative claims that may arise due to the fact that the production, reproduction, sale, distribution or any act related to the sale of the product or service is contrary to any regulation in force, and that he/she is obliged to defend BAYTII in front of all kinds of judicial, commercial and administrative authorities against the requests made to BAYTII in this direction.
BAYTII Filtering Service
This Service is to ensure that the advertisement contents entered by the Member through his/her BAYTII Account are displayed under the categories on the BAYTII Portal. Filtering: through the dynamic infrastructure of the BAYTII Portal, it is the display of the advertisements belonging to the Member by the Visitor through the BAYTII interface in the order determined by BAYTII in line with the queries customized by the Visitors under the relevant categories. Filtering is based on the principle of displaying to the Visitor the automatic responses of the computer program running on the BAYTII database to the queries received by the BAYTII database. The selection of the category under which the advertisement(s) will be displayed belongs primarily to the Member. In the event that the category determined by the Member is not related to the subject of the advertisement; BAYTII may ensure that the relevant advertisement is displayed under the category related to the subject of the advertisement without any notification to the Member.
BAYTII Additional Services
In addition to the basic services listed above, the Member may benefit from the Services announced on the Portal and whose terms of use are specified in the relevant sections of the Portal, if a fee is stipulated for the relevant service, by paying the specified fee. The Member accepts and undertakes to comply with the obligations within the framework of the explanations made in the relevant section of the Portal regarding the services defined by BAYTII within the scope of this article and announced in the relevant section of the Portal.
Campaigns and Offers
BAYTII has the right and authority to determine the fees and pricing structures of the advertisements to be published on the Portal. BAYTII may organize various campaigns or offers while determining the fees and pricing structures of the advertisements. The campaigns or offers are valid for natural and legal persons using the Portal. Once a natural or legal person has benefited from a campaign or offer using a BAYTII Account belonging to him/her, he/she cannot benefit from the same campaign or offer again by opening a new BAYTII Account or using another existing BAYTII Account. In the event that it is revealed that they benefit from the same campaign or offer again, their account(s) may be closed by BAYTII. Campaigns or offers offered to real and legal persons cannot be transferred. BAYTII has the right to organize various campaigns, sweepstakes, etc. for the Members from time to time. Members are obliged to participate in these campaigns, sweepstakes, and other events by using their 'Username'. Transactions made by the Profile Page Users with their 'Username' do not entitle the Commercial Member to participate in the campaign and/or sweepstakes. The general conditions regarding such campaigns and sweepstakes organized by BAYTII are stated below. Besides, BAYTII reserves the right to determine different or additional conditions regarding any campaign or sweepstakes: In order to benefit from any raffle and campaign, the transaction that gives the right to participate in the raffle or campaign must be carried out within the raffle and/or campaign period determined by BAYTII. In the event that the transaction that gives the right to participate in the lottery and/or campaign is withdrawn or returned for any reason before the lottery and/or campaign is concluded, the Commercial Member shall also lose the right to participate in the lottery and/or campaign. In order to participate in any campaign or lottery or to benefit from the results of the campaign or lottery, the Commercial Account must not have been canceled by BAYTII or by the Commercial Member.
